1. Стороны и согласие с условиями

Эти условия — лицензионное соглашение между вами и индивидуальным предпринимателем Ильиным Павлом Антоновичем (Грузия, идентификационный номер 345667655, адрес: г. Батуми, проспект Тамар Мепе, д. 22а, кв. 143; «мы») о приложении Foldy 3D («приложение»). Устанавливая или используя приложение, вы соглашаетесь с ними. Если вы не согласны, не пользуйтесь приложением. Если вы не достигли совершеннолетия, условия за вас принимает родитель или законный представитель, и он отвечает за то, как вы пользуетесь приложением.

2. Что даёт приложение

Foldy 3D содержит каталог моделей, развёртки для печати и пошаговые инструкции, как вырезать, сложить и склеить фигуры из бумаги. Каталог обновляется с нашего сервера: мы можем добавлять, менять и убирать модели. Для загрузки каталога и обновлений нужен интернет; уже скачанные модели открываются без него. Мы можем менять приложение, его функции и оформление. Часть моделей и функций доступна только по подписке Foldy 3D Pro (раздел 3) — в приложении они отмечены.

3. Подписка Foldy 3D Pro

• Foldy 3D Pro — автоматически продлеваемая подписка на месяц или на год. Цена и срок каждого плана показаны в приложении до покупки, в валюте вашей страны App Store.
• Оплата списывается с вашего Apple Account, когда вы подтверждаете покупку. Подписка продлевается автоматически на тот же срок и по той же цене, если вы не отключили автопродление не позднее чем за 24 часа до конца текущего периода. Плата за продление списывается в течение 24 часов до конца периода.
• Управлять подпиской и отключить автопродление можно в настройках Apple Account («Настройки» → ваше имя → «Подписки») или по ссылке в приложении. Удаление приложения подписку не отменяет. После отключения автопродления Pro работает до конца оплаченного периода.
• Если в приложении предложен бесплатный пробный период, его неиспользованная часть сгорает, когда вы оформляете подписку. Сейчас пробный период не предлагается.
• Оплату и возвраты проводит Apple по правилам App Store; запросить возврат можно на reportaproblem.apple.com. За неиспользованную часть периода деньги не возвращаются, кроме случаев, когда этого требует закон. Ваше право отказаться от покупки по закону вашей страны сохраняется.
• Подписка привязана к вашему Apple Account: на другом устройстве с тем же Apple Account нажмите «Восстановить покупки». Семейный доступ на подписку не распространяется.
• Мы можем менять состав Pro и цены. О повышении цены Apple сообщит заранее и, если этого требуют её правила, спросит ваше согласие; новая цена действует со следующего периода.

4. Лицензия: что можно и чего нельзя

Мы даём вам личную, некоммерческую, неисключительную, непередаваемую и отзывную лицензию пользоваться приложением на устройствах Apple, которые принадлежат вам или которыми вы управляете, в пределах правил App Store (Usage Rules). Права, которые прямо не предоставлены, остаются за нами.

• Можно печатать и собирать развёртки сколько угодно — для себя, семьи, друзей, на занятиях в школе или кружке.
• Собранные фигуры — ваши: их можно дарить, показывать, фотографировать и публиковать фотографии.
• Нельзя продавать развёртки, PDF-файлы и модели, выкладывать их для скачивания, распространять в составе других продуктов или использовать в коммерческих целях без нашего письменного согласия.
• Нельзя копировать, изменять, разбирать или декомпилировать приложение, обходить его защиту, массово скачивать содержимое с нашего сервера или мешать его работе, кроме случаев, которые прямо разрешены законом.

5. Безопасность

Для сборки нужны ножницы или макетный нож и клей. Дети работают с ножом, ножницами и клеем только под присмотром взрослых. Следуйте инструкциям к инструментам и клею. Мелкие детали и обрезки держите подальше от детей младше 3 лет — ими можно подавиться.

6. Печать

Развёртки рассчитаны на печать в масштабе 100%. Результат зависит от принтера, бумаги и настроек печати, поэтому мы не гарантируем, что детали точно сойдутся на любом оборудовании. Перед печатью на плотной бумаге проверьте масштаб: в настройках приложения есть проверочный лист.

7. Права на содержимое

Приложение, модели, развёртки, тексты, изображения и оформление принадлежат нам или нашим лицензиарам и охраняются законом. Шрифты Geologica и IBM Plex Mono используются по лицензии SIL Open Font License 1.1. Названия и знаки Apple, App Store, iPhone и iPad принадлежат Apple Inc.

8. Конфиденциальность

Какие данные обрабатывает приложение, описано в политике конфиденциальности; она — часть этих условий.

9. Без гарантий

Приложение и содержимое предоставляются «как есть» и «как доступно». Мы стараемся, чтобы всё работало хорошо, но не гарантируем, что в приложении нет ошибок, что оно подойдёт для ваших целей, что сервер каталога будет доступен без перерывов. В той мере, в какой это допускает закон, мы отказываемся от любых подразумеваемых гарантий, в том числе гарантий пригодности для определённой цели и ненарушения прав.

10. Ограничение ответственности

В той мере, в какой это допускает закон, мы не отвечаем за косвенный, случайный, специальный или последующий ущерб, упущенную выгоду, потерю данных, а также за травмы, порчу материалов или имущества при печати и сборке. Наша общая ответственность перед вами по всем требованиям, связанным с приложением, не превышает суммы, которую вы заплатили за приложение и подписку за последние 12 месяцев, а если вы ничего не платили — 50 долларов США. Ничто в этих условиях не ограничивает ответственность за вред жизни и здоровью по нашей вине, за умысел и грубую неосторожность, а также ответственность, которую по закону ограничить нельзя.

11. Apple

• Эти условия заключены между вами и нами, а не с Apple. За приложение и его содержимое отвечаем мы, а не Apple.
• Apple не обязана обслуживать и поддерживать приложение. С вопросами и претензиями обращайтесь к нам.
• Если приложение не соответствует применимой гарантии, вы можете сообщить об этом Apple, и Apple вернёт вам цену покупки, если она была. В той мере, в какой это допускает закон, других гарантийных обязательств в отношении приложения у Apple нет.
• Претензии, связанные с приложением, в том числе об ответственности за продукт, о несоответствии требованиям закона и о защите прав потребителей, рассматриваем мы, а не Apple.
• Если третье лицо заявит, что приложение или то, как вы им пользуетесь, нарушает его права на интеллектуальную собственность, разбираться с этим будем мы, а не Apple.
• Вы подтверждаете, что не находитесь в стране под эмбарго правительства США или в стране, которую правительство США считает поддерживающей терроризм, и не включены в списки лиц, с которыми правительство США запрещает или ограничивает сделки.
• Пользуясь приложением, соблюдайте условия сторонних сервисов, например вашего оператора связи.
• Apple и её дочерние компании — сторонние бенефициары этих условий; приняв условия, вы даёте Apple право требовать их соблюдения от вас.

12. Применимое право и споры

Эти условия регулируются законодательством Грузии. Споры рассматривают суды Тбилиси, Грузия. Если вы потребитель и живёте в ЕС, Великобритании или другой стране, законы которой дают вам обязательную защиту, этот выбор права не лишает вас такой защиты, и вы можете обратиться в суд своей страны. Прежде чем идти в суд, напишите нам на earthquakedev@icloud.com — постараемся решить вопрос в течение 30 дней.

13. Изменения и прекращение

Мы можем обновлять эти условия. Новая версия публикуется на этой странице с новой датой; о существенных изменениях расскажем в приложении или в описании обновления. Если вы продолжаете пользоваться приложением после изменений, значит, согласны с ними. Вы можете прекратить пользоваться приложением в любой момент, удалив его (подписку при этом отключите отдельно, см. раздел 3). Если вы нарушаете эти условия, лицензия прекращается автоматически.

14. Прочее

Если какое-то положение окажется недействительным, остальные продолжают действовать. Если мы не потребовали соблюдения какого-то положения, это не отказ от него. Вы не можете передать свои права по этим условиям другому лицу без нашего согласия; мы можем передать свои права и обязанности вместе с приложением. Эти условия вместе с политикой конфиденциальности — полное соглашение между вами и нами о приложении.

Terms of Use

1. Parties and acceptance

These terms are a license agreement between you and Ilin Pavel, an individual entrepreneur registered in Georgia (identification number 345667655, address: Batumi, Tamar Mefe avenue, N 22 a, Flat N143; “we”), for the Foldy 3D app (the “app”). By installing or using the app you accept them. If you don’t agree, please don’t use the app. If you are a minor, your parent or legal guardian accepts these terms on your behalf and is responsible for your use of the app.

2. What the app provides

Foldy 3D contains a catalog of models, printable templates and step-by-step instructions for cutting, folding and gluing paper figures. The catalog is updated from our server: we may add, change and remove models. Downloading the catalog and updates requires an internet connection; models you have already downloaded open offline. We may change the app, its features and design. Some models and features are available only with a Foldy 3D Pro subscription (section 3) and are marked in the app.

3. Foldy 3D Pro subscription

• Foldy 3D Pro is an auto-renewable subscription for one month or one year. The price and length of each plan are shown in the app before purchase, in the currency of your App Store country.
• Payment is charged to your Apple Account when you confirm the purchase. The subscription automatically renews for the same period and at the same price unless auto-renew is turned off at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the end of the current period.
• You can manage the subscription and turn off auto-renew in your Apple Account settings (Settings → your name → Subscriptions) or through the link in the app. Deleting the app does not cancel the subscription. After you turn off auto-renew, Pro stays active until the end of the paid period.
• If the app offers a free trial, any unused portion of it is forfeited when you purchase a subscription. No free trial is offered at the moment.
• Payments and refunds are handled by Apple under the App Store rules; you can request a refund at reportaproblem.apple.com. Unused portions of a period are not refunded except where required by law. Any statutory right of withdrawal you have under the laws of your country is not affected.
• The subscription is tied to your Apple Account: on another device with the same Apple Account, tap Restore Purchases. Family Sharing is not available for the subscription.
• We may change what Pro includes and its prices. Apple will notify you of a price increase in advance and, where its rules require, ask for your consent; the new price applies from the next period.

4. License: what you may and may not do

We grant you a personal, non-commercial, non-exclusive, non-transferable, revocable license to use the app on Apple devices that you own or control, as permitted by the App Store Usage Rules. All rights not expressly granted are reserved.

• You may print and build the templates as often as you like — for yourself, your family and friends, or in a school or club class.
• The figures you build are yours: you may give them away, show them, photograph them and publish the photos.
• You may not sell the templates, PDF files or models, post them for download, distribute them as part of other products, or use them commercially without our written permission.
• You may not copy, modify, disassemble or decompile the app, circumvent its protections, bulk-download content from our server or interfere with its operation, except where the law expressly allows it.

5. Safety

Building requires scissors or a craft knife and glue. Children should use knives, scissors and glue only under adult supervision. Follow the instructions for your tools and glue. Keep small parts and scraps away from children under 3 — they are a choking hazard.

6. Printing

Templates are designed to be printed at 100% scale. Results depend on your printer, paper and print settings, so we can’t guarantee that parts will match exactly on every setup. Before printing on heavy paper, check the scale with the test sheet in the app’s settings.

7. Content ownership

The app, models, templates, texts, images and design belong to us or our licensors and are protected by law. The Geologica and IBM Plex Mono fonts are used under the SIL Open Font License 1.1. Apple, App Store, iPhone and iPad are trademarks of Apple Inc.

8. Privacy

The data the app processes is described in our Privacy Policy, which forms part of these terms.

9. No warranties

The app and its content are provided “as is” and “as available”. We work to make everything reliable, but we don’t guarantee that the app is error-free, fit for your purposes, or that the catalog server will be available without interruption. To the extent permitted by law, we disclaim all implied warranties, including fitness for a particular purpose and non-infringement.

10. Limitation of liability

To the extent permitted by law, we are not liable for indirect, incidental, special or consequential damages, lost profits or lost data, or for injury or damage to materials or property during printing and building. Our total liability to you for all claims relating to the app will not exceed the amount you paid for the app and the subscription in the last 12 months or, if you paid nothing, USD 50. Nothing in these terms limits liability for death or personal injury caused by our negligence, for intent or gross negligence, or any liability that cannot be limited by law.

11. Apple

• These terms are between you and us, not Apple. We, not Apple, are solely responsible for the app and its content.
• Apple has no obligation to provide maintenance or support for the app. Please contact us with questions and claims.
• If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.
• We, not Apple, are responsible for addressing any claims relating to the app or your use of it, including product liability claims, claims that the app fails to conform to legal or regulatory requirements, and consumer protection claims.
• If a third party claims that the app or your use of it infringes their intellectual property rights, we, not Apple, are responsible for the investigation, defense, settlement and discharge of that claim.
• You represent that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties.
• You must comply with applicable third-party terms, such as those of your wireless carrier, when using the app.
• Apple and its subsidiaries are third-party beneficiaries of these terms, and upon your acceptance Apple has the right to enforce them against you.

12. Governing law and disputes

These terms are governed by the laws of Georgia. Disputes are resolved by the courts of Tbilisi, Georgia. If you are a consumer living in the EU, the UK or another country whose laws give you mandatory protection, this choice of law does not deprive you of that protection, and you may bring proceedings in the courts of your country. Before going to court, please email us at earthquakedev@icloud.com — we will try to resolve the issue within 30 days.

13. Changes and termination

We may update these terms. The new version is posted on this page with a new date; we will announce significant changes in the app or in the update notes. By continuing to use the app after changes, you accept them. You can stop using the app at any time by deleting it (turn off the subscription separately, see section 3). If you breach these terms, your license ends automatically.

14. Miscellaneous

If any provision is found invalid, the rest remain in effect. Our failure to enforce a provision is not a waiver of it. You may not transfer your rights under these terms without our consent; we may transfer our rights and obligations together with the app. These terms, together with the Privacy Policy, are the entire agreement between you and us regarding the app.
